These terms govern use of homecinemastore.co.za and enquiries, quotations, orders, design services, supply, delivery, installation and related services provided by us. They must be read with our Privacy/POPIA Policy and Returns, Cancellations & Special Orders Policy.
2. Specialist enquiry and quotation service
Home-cinema equipment is often selected, configured and installed for a particular room. Product pages are invitations to enquire and do not constitute binding offers. Unless expressly stated otherwise, products are supplied on a quotation or enquiry basis and public prices are not displayed.
A binding agreement arises only when we issue a written quotation or order confirmation, you accept it in the manner stated, and any required deposit or payment has cleared. A quotation applies only for its stated validity period and may be revised if supplier pricing, exchange rates, duties, shipping costs, taxes, availability or the project scope changes before acceptance.
3. Product information and suitability
We take reasonable care to present current and accurate product information. Manufacturer specifications, finishes, model availability, packaging and images can change without notice. Images are illustrative and screen colours may vary.
You are responsible for giving us accurate room, equipment, access, electrical, network and project information. We will provide specialist recommendations with reasonable care, but performance also depends on the room, installation conditions, associated equipment, source material and user preferences.
4. Prices, VAT and payment
Unless a quotation states otherwise, quoted South African prices include VAT where applicable. The quotation will state payment timing, deposits and any delivery, travel, design, installation, calibration or commissioning charges.
We may require cleared payment before ordering, dispatching or installing equipment. Ownership remains with us until the full amount due has been paid, while risk passes as provided in the accepted quotation and applicable law. You may not withhold payment for an unrelated dispute.
5. Availability, procurement and special orders
Stock and supplier availability are not guaranteed until confirmed. Imported, made-to-order, customised, configured, colour-specific, cut-to-size, licensed or otherwise specially procured goods may require a non-refundable deposit once procurement has begun, subject always to rights that cannot lawfully be excluded.
We will identify special-order or configured items in the quotation where reasonably possible. Lead times are estimates and may be affected by manufacturers, distributors, international transport, customs, strikes, component shortages and other events beyond our reasonable control. We will keep you informed of material delays.
6. Delivery and collection
Delivery or collection arrangements will be confirmed in writing. You must ensure safe, reasonable access and have an authorised person available to receive goods. Please inspect packages promptly and report visible damage, shortages or incorrect items as soon as reasonably possible, preferably with photographs. This does not limit statutory rights.
Collection of high-value equipment is by prior appointment only. The public address is not an invitation for walk-in retail visits or unscheduled collections.
7. Installation, calibration and commissioning
Installation work is limited to the agreed scope. Unless included in writing, quotations exclude building work, electrical certification, structural alterations, specialist rigging, concealed cabling routes, painting, network remediation and work by third-party trades.
You must provide safe access, suitable power and networking, and disclose known hazards. Additional work or return visits caused by incomplete third-party work, inaccessible areas, changed instructions or inaccurate site information may be quoted separately. System performance will be demonstrated or commissioned as agreed.
8. Design and consulting services
Design, specification, drawings, calibration and consulting are professional services. Deliverables, revisions, assumptions and fees will be stated in the quotation. Unless otherwise agreed, our designs may be used only for the project for which they were supplied and may not be resold or reproduced commercially.
9. Cancellations, returns and defects
Cancellations and returns are handled under our Returns, Cancellations & Special Orders Policy and applicable South African law. Nothing in these terms excludes or restricts rights under the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable legislation where those rights apply.
Manufacturer warranties are subject to their terms. We will assist with valid warranty processes for goods supplied by us. Warranty coverage normally excludes misuse, unauthorised modification, unsuitable power, liquid or impact damage, improper third-party installation and ordinary wear.
10. Website use and intellectual property
Website content is provided for general information and may not reflect every available configuration. Product names, trademarks and manufacturer images belong to their respective owners. Our site design, original text, photography, specifications, drawings and branding may not be copied or commercially reused without permission.
You must not misuse the website, attempt unauthorised access, introduce malicious material, scrape it excessively or use its content in a misleading or unlawful manner.
11. Privacy and communications
We process personal information as described in our Privacy/POPIA Policy. By making an enquiry, you authorise us to respond using the contact details provided. We will not treat an enquiry as consent to unrelated direct marketing.
12. Liability
We are responsible for losses to the extent required by applicable law. To the fullest extent lawfully permitted, we are not liable for indirect or consequential loss, loss of profit, loss arising from incompatible third-party equipment or services, or delay caused by events beyond our reasonable control. Any limitation does not apply where it would be unlawful, including liability that may not be excluded under consumer-protection legislation.
13. Changes, severability and governing law
We may update these website terms from time to time. The terms applicable to an accepted order are those incorporated into that agreement. If a provision is invalid or unenforceable, the remaining provisions continue to apply.
These terms are governed by the laws of the Republic of South Africa. The parties submit to the jurisdiction of South African courts, without limiting any consumer’s right to approach an applicable regulator, ombud or tribunal.
